Medical Negligence Claim Filed Against Hospital After Patient Discharged Without Treatment for a Stroke

WASHINGTON, INDIANA — A former patient of Daviess County Hospital has filed a complaint with the Indiana Department of Insurance alleging medical negligence because the patient was discharged from the ER after suffering a stroke without proper and necessary assessment and treatment. As a result, the complaint alleges, the former patient has suffered severe and permanent disability and harm.

According to the complaint, the patient was taken by ambulance to the Daviess County Hospital ER where she was was noted with classic signs and symptoms of a stroke, including dizziness, lightheadedness, weakness, double vision, sudden onset of vertigo, a decreased ability to stand and walk, and vomiting. The complaint further alleges that despite these symptoms, the Daviess Community Hospital staff “clearly, inexplicably, and repeatedly, failed to follow accepted standards of care required under the circumstances” and the patient was discharged after suffering a stroke without proper and necessary assessment and treatment during this critical time period, and without diagnosing or recognizing the stroke.

According to the complaint, the following day, the patient was taken to a different hospital, Good Samaritan Hospital, where she was admitted and properly diagnosed with a stroke; however, by this time the window of opportunity to implement critical therapies had tragically passed.

According to the American Stroke Association, there are a variety of treatments that can be used to treat a stroke, and it is “important to identify a stroke and seek treatment immediately for the best possible chance at a full recovery.”

The proposed complaint filed in this matter with the Indiana Department of Insurance is a public record.
