Valparaiso Nursing Home Named In Wrongful Death Claim

Wrongful Death Claim filed with Indiana Department of Insurance

VALPARAISO, IN– The family of a former patient of Valparaiso Care and Rehabilitation has filed a wrongful death claim against the facility alleging the patient was allowed to fall and suffered a massive brain bleed, following a medication error.

According to the complaint which was filed with the Indiana Department of Insurance, the patient “administered incorrect dosages of anti-coagulant medication(s)” which subjected the patient “to a dangerous risk of harm and death.” The complaint goes on to state that after the medication error(s), the patient “suffered a fall that caused a massive brain bleed” resulting in the “wrongful death” of the patient.

In support of the allegations, the complaint goes on to state that Valparaiso Care and Rehabilitation failed “to provide sufficient nurse and support staffing to meet the needs and ensure the safety of patients under their care,” and further “failed to properly train and supervise employees to care for geriatric patients.”

The complaint further states that these care violations, “demonstrate serious systemic failures in the hiring, staffing, training, oversight, and management” of Valparaiso Care and Rehabilitation staff.

According to the complaint, a number of corporate entities are alleged to have been involved in the ownership and operation of the facility, including Valparaiso Care and Rehabilitation Center, LLC, Health and Hospital Corporation of Marion County, and American Senior Communities, Inc.

According to the complaint, the defendants have refused to accept responsibility for the patient’s harm.

The complaint is a public record on file with the Indiana Department of Insurance.
